CHARLESTON, W.Va. — A Kanawha Circuit Court hearing this afternoon will address whether Governor Patrick Morrisey has the legal authority to deploy members of the West Virginia National Guard to assist in Washington, D.C.
The deployment, which could extend into early 2026, has drawn questions about the limits of the governor’s power under state and federal law.
The court is expected to review arguments concerning the scope of the governor’s executive authority, as well as the nature of the Guard’s role in federal operations outside state borders.
No timeline has been announced for a ruling.
