COLUMBUS, Ohio — Intoxicating hemp products remain on sale across Ohio after a judge temporarily blocked Governor Mike DeWine’s executive order banning them.
The decision comes after three retailers filed a lawsuit arguing that the governor overstepped his authority and violated state law by attempting to ban the products through executive action rather than legislation.
Governor DeWine issued the order earlier this month, citing concerns over public health and the unregulated sale of hemp-derived intoxicants, including Delta-8 THC. However, the court’s ruling halts enforcement of that order while the case moves forward.
For now, retailers are allowed to continue selling the products — though the legal battle over how Ohio regulates hemp-derived substances is far from over.
