MARSHALL COUNTY, W.Va. – Marshall County Magistrate Zachary Allman on Wednesday rejected a proposed plea agreement in the case against former West Virginia State Sen. Dr. Michael Maroney, who faces charges of indecent exposure, disorderly conduct, and driving under the influence (DUI).
Allman set a trial on the DUI charge Maroney must answer on April 30 at 9 a.m. in Marshall County Circuit Court.
The decision was handed down during an evidence suppression and bond revocation hearing at the Marshall County Courthouse.
On a separate charge of indecent exposure, Allman revoked Maroney’s current bond when he failed to produce evidence to the court that he complied with an order to enroll in substance abuse treatment.
Allman then reset Maroney’s bond to $1,500 dollars cash only. To comply with the new bond, Maroney has five days to enter a drug treatment program and provide evidence of it to the court.
Maroney’s charges stem from two separate incidents. The indecent exposure and disorderly conduct charges arise from an Aug. 4, 2024 incident at Gumby’s in Glen Gale. Closed-circuit cameras at the establishment captured footage that allegedly showed Maroney engaging in an act of sexual gratification. During that evening, Glen Dale Police Chief Ed Vogler, who was dispatched to the scene, recounted that employees at Gumby’s observed Maroney’s behavior, prompting him to retrieve the video evidence via a subpoena from the establishment’s main headquarters.
In a separate incident on Sept. 23, 2024, Maroney was pulled over by McMechen Police after committing “numerous traffic infractions.” Following a roadside investigation, Police Chief Robert Shilling confirmed Maroney was arrested on suspicion of DUI.
