COLUMBUS, Ohio — Three Ohio companies have filed a lawsuit against Gov. Mike DeWine following his executive order temporarily banning the sale of intoxicating hemp products across the state, according to WLWT.
Fumee Smoke and Vape, Invicta Nutraceuticals, and Titan Logistics Group filed the civil suit against DeWine and the Ohio Department of Agriculture, arguing the order is “unlawful” and lacks evidence that hemp products pose a public health threat.
Under the executive order, which takes effect Oct. 14, retailers must remove intoxicating hemp products from store shelves and stop all sales or face fines. The 90-day order could expire or be extended, depending on legislative action.
DeWine said the temporary ban does not affect non-intoxicating hemp products or marijuana legally sold in licensed dispensaries. He added the order targets synthetic and intoxicating hemp products that he described as “simply dangerous.”
