West Virginia Tax Division Seeks Role in Greenbrier Resort Lawsuit

CHARLESTON, W.Va. — The West Virginia State Tax Division is continuing its push to become involved in the ongoing federal lawsuit surrounding The Greenbrier Resort and businesses tied to U.S. Sen. Jim Justice and his family.

In a court filing submitted this week, state tax officials argued they should be allowed to intervene in the case because they hold more than $4.4 million in tax liens connected to properties involved in the litigation.

The lawsuit was filed by White Sulphur Springs Holdings LLC, a subsidiary of Texas-based TRT Holdings, which acquired hundreds of millions of dollars in Greenbrier-related debt earlier this year. The company is seeking court oversight of the resort’s operations while financial disputes are resolved.

Although both sides acknowledge the existence of the tax liens, the Tax Division argues its interests are distinct from those of the current parties and could be affected by future court decisions.

According to state filings, the Justice family and related businesses owe more than $3.9 million in consumer sales and use taxes, along with approximately $455,000 in withholding tax obligations.

The legal battle centers on debt tied to The Greenbrier Resort, which exceeds $370 million. Court proceedings have been delayed while the Justice family works to secure refinancing through a proposed agreement with a new lender.

Tax officials maintain that participation in the lawsuit is necessary to protect the state’s collection rights and ensure its tax liens receive proper consideration as the case moves forward.
