WHEELING, W.Va. — An Ohio County jury has awarded $3.77 million to Julie Daley, age 64, after finding medical malpractice by a doctor and physician assistant at WVU Medicine Wheeling Hospital.
Following a four-day trial, jurors determined Dr. Barry Mitchell and Physician Assistant Michelle Porembka were negligent in their treatment of Daley. The case stemmed from an incident in June 2022 when Daley sought treatment in the hospital’s emergency department complaining of abdominal issues.
According to court findings, Daley’s condition worsened following treatment, ultimately requiring her to undergo a permanent colostomy.
Daley was represented by attorneys Geoff Brown and Tyler Smith of Bordas & Bordas. The medical providers were represented by attorneys Mark Robinson and David Givens of Flaherty, Sensabaugh & Bonasso. Ohio County Circuit Judge Jason Cuomo presided over the trial.
